Multi-Tenant BPS Roadmap…

If I was the owner / operator of a multi-tenant building in a Building Performance Standard (BPS) jurisdiction, here’s the roadmap I would follow…

📋 Know the timelines:  when will you get a notice letter? When do you have to start reporting?
📋 Think about data:  what do you need and how are you going to get it.
--Work with utilities
--BPS laws vary widely regarding access to tenant data.
--Develop an understanding of a reasonable level of assurance
📋Research:  any funding opportunities (there are more than you think)
📋Develop a process:  to meet reporting requirements, then performance requirements.
📋Educate tenants:  get your stakeholders engaged, you are going to need their help.
📋Review and revise: your leases to accommodate for the above, including access to tenant data.
📋Always take an equity lens: consider and mitigate against any disproportionate impacts associated with compliance.
And here's your friendly reminder that multi-family deadlines are not as far out as you think, and you will need whole building (including tenant) data by the reporting deadlines, even if there are not (yet) performance targets.
❓ What did I miss? I'm a Climate Lawyer and I help building owners comply with new regulations, and align owners and tenants towards shared climate goals. Reach out with questions.
